South Africa:Speeding motorists risk insurance claim rejection

| 07 May 2026

Motorists driving over speed limits in South Africa risk having insurance claims rejected in the case of accidents.

The National Financial Ombud Scheme issued the warning, saying that it has noted that while standard policies cover negligence, crashes resulting from high speeds are classified as a breach of the 'due care' clause. When speeding is found to be the cause of an accident, insurers often invoke the 'due care' exclusion to reject claims outright.

South Africa has one of the highest road death tolls on the continent, with road fatalities averaging about 14,000 a year, according to the Automobile Association.
