Turkiye:Regulator overhauls loss adjuster appointment rules

A new regulation on the Appointment of Insurance Adjusters will come into force on 1 April 2026, that will reshape the adjuster appointment process, job acceptance principles and the fee system.

The regulation was published in the Official Gazette on 12 February 2026 by the Insurance and Private Pension Regulation and Supervision Authority (SEDDK). It aims to ensure that loss adjusting activities are conducted in a way that increases confidence in the sector and protects the rights and interests of all parties.

According to the regulation, the assignment of loss adjusters to accidents covered by motor third-party liability insurance (also known as traffic insurance) will be automatic, based on a predefined list, rather than the adjuster being freely selected by the insurer. The mandatory process will be carried out through the Adjuster Assignment and Tracking System (EKSIST).

The system automatically assigns the next eligible adjuster in line based on objective criteria such as geographic region, sub-specialisation, workload distribution and performance score. This reduces favouritism and conflicts of interests. Before the new regulation is introduced, insurers choose which adjuster to appoint.

The new regulation stipulates that if the outstanding damage amount exceeds one-tenth of the minimum material damage coverage amount, it will be mandatory for the damage assessment to be carried out by an adjuster.

In comprehensive motor insurance, the sequential appointment system applies in cases involving heavy damage or total loss decisions.

The right of the insured to appoint an adjuster

At the same time, under the new regulation, the insured, the policyholder, or the beneficiary of the contract is granted the right to appoint an expert at every stage. Insurance companies will be required to explicitly state this right in their policies.

After receiving a damage claim, companies are to forward the file information to the Insurance Information and Monitoring Centre no later than the next business day.

Pricing and minimum tariff

The appraisal fee will be freely determined by the parties, provided it is not less than the minimum appraisal fee schedule in effect on the date of appointment. The fee for the initial appraisal report will be paid by the insurance company.

The party responsible for paying the appeal and arbitration expert fees will be determined based on the nature of the difference between the reports. If there is a significant difference, the fee will be paid by the party against whom the decision is unfavourable.

The base appraisal fee schedule will be increased annually in line with the annual Consumer Price Index rate announced by the Turkish Statistical Institute.

Pilot scheme to be carried out in Bursa and Ordu

The sequential assignment system for motor insurance will be implemented as a pilot programme in Bursa and Ordu provinces for a period of three months from the date the regulation comes into effect. The board may extend the pilot period up to six months.

Appeal mechanism

The parties may object to the expert report within three business days. In case of an objection, a new expert will be appointed via EKSIST. If a request is received within three business days, an arbitrator expert will be appointed from among individuals who have actively worked as experts in the relevant field for at least 10 years. The report prepared by the arbitrator expert will be accepted as the final report.

Appeal and expert reports for the motor vehicle branch must be prepared within a maximum of three business days; for other branches, within 10 business days.
